West Virginia Permit Guide for Metal Carports, Garages and Barns

West Virginia's State Building Code only applies where a county or city has chosen to adopt it, so whether a carport needs a permit depends on where you build. Many West Virginia counties have not, so in a lot of rural areas there's no building permit for a carport or garage at all. Cities and some counties do enforce the code and will want a permit and plans. Start by calling your county commission office or your city hall and asking what applies at your address.

Building code in effect

The West Virginia State Building Code is a legislative rule (Title 87, Series 4) written by the State Fire Commission. It is local-option: under W. Va. Code 15A-11-5, each county or city may adopt it, and must notify the State Fire Marshal when it does. The 2022 version was built on the 2018 International Codes. City adoption ordinances from 2026 show the rule was updated effective July 29, 2026 to reference the 2024 International Building Code and 2024 International Residential Code. Ask your local office which edition it enforces, since each town or county adopts the state code on its own schedule.

Who issues permits

Building permits come from the county or city that adopted the State Building Code. Enforcement is the job of that local jurisdiction, not the state. If your county hasn't adopted the code and you live outside a city that has, there may be no building permit for a residential carport or garage. You may still need other local approvals, such as zoning in cities and counties that have it, or a floodplain permit if you're near a creek or river, so call before you build.

When you need a permit

  • No local code, no building permit: The state code only applies where a county or city has adopted it. In areas that haven't, there's usually no building permit for a home carport or garage.
  • Farm buildings: Buildings used mainly for agriculture are exempt from the State Building Code and from any local building code, even in counties that have adopted one.
  • Cities are different: Many West Virginia cities and towns enforce the State Building Code and have zoning, so a carport inside city limits is more likely to need a permit than one out in the county.
  • Commercial property: A building for a business is reviewed under the building code where your local government has adopted it. Ask your local office what plans they want.

Farm buildings

West Virginia has one of the clearest farm exemptions around. Under W. Va. Code 15A-11-5, buildings or structures used primarily for agricultural purposes are exempt from the State Building Code, the State Fire Code and any local building code or ordinance. Agricultural purposes, as defined in W. Va. Code 15A-11-3, include raising, harvesting, producing, marketing or storing crops and livestock, and storing machinery or equipment used for farm production. This came from House Bill 2823 in 2021. A barn for hay, livestock or farm equipment generally fits, but a building used as a home shop or for storing personal vehicles may not.

Wind and snow

West Virginia is mountain country, and snow is the bigger concern than wind in most places. Higher elevations in the eastern counties can see much heavier snow than the river valleys, and ridgetop sites can get stronger wind. If your county or city enforces the building code, ask them what wind speed and snow load to design for. If there's no local code, it's still smart to buy for your actual site conditions. Our partnered manufacturers offer certified buildings rated for 140 MPH wind and 35 PSF snow load, and higher ratings can be quoted where required.

Before you order

  • Call your county commission office or city hall before you order. Ask if they enforce the State Building Code, if you need a building permit, a zoning permit or both, the setbacks, and what wind and snow ratings they want.
  • Ask about floodplain rules if your property is near a creek or river. A floodplain permit can apply even where there's no building permit.
  • Check your HOA rules and deed restrictions. They can limit size, color or placement even where the county has no code.
  • Have a level site ready before delivery: a concrete slab, a gravel pad or well-graded ground. If your local office wants engineered drawings for a certified building, let us know and we can help you get them.

Common questions

Do I need a permit for a carport in West Virginia?
Only if your county or city has adopted the State Building Code or has its own zoning rules. Many rural counties don't issue building permits, but cities often do. Call your county or city office to find out.

Do I need a permit for a metal garage in West Virginia?
If your county or city enforces the State Building Code, expect to need a permit and plans. If it doesn't, there may be no building permit, but zoning or floodplain rules can still apply.

Are farm buildings exempt?
Yes. State law exempts buildings used primarily for agricultural purposes from the State Building Code and from local building codes. That includes buildings for storing crops, livestock and farm equipment.
