Sussex County, VA Permits for Metal Carports and Garages

Virginia

Yes, count on paperwork: a Sussex County carport permit begins with a $75 Zoning Permit, and the county also expects a building permit for new construction. Carports sit in the same zoning category as sheds and additions on the county's requirements page. The Director of Planning reviews your plans against the Zoning Ordinance before the Building Official issues anything. Both offices share the Princeton Road address and keep the same 8:00 a.m. to 4:30 p.m. weekday hours.

Permit office: Sussex County Building Inspections, with the Planning and Zoning Department for zoning

When a permit is required

  • Zoning Application, site plan, and Erosion & Sediment Control Screening Form for a shed, carport or other accessory structure
  • Zoning Permit, listed at $75 on the county fee schedule
  • Building permit issued by the Building Official after zoning review, unless an exemption applies
  • Possible Health Department or Department of Transportation approval, depending on the site

Zoning and setbacks

Call Planning and Zoning at 434-246-1043 to confirm how your parcel is zoned. The county says most land outside town limits is A-1 General Agricultural, and the Commissioner of the Revenue can give you the tax map number the office will need. The county's zoning page does not publish setback distances, so ask for them before you pick a spot. Your site plan has to show how far the building sits from each property line.

What to bring

  • Two copies of an approved, recorded plat showing where the building goes and its distance from property lines and other structures
  • Two sets of plans with wall sections, elevations and floor plans
  • Completed Zoning Application and $75 fee
  • Erosion & Sediment Control Screening Form with the acres and square feet you will disturb

Farm buildings

State law takes qualifying farm buildings out of the building code, though not one used as a restaurant, and flood plain and mudslide rules stay in force. Sussex has its own route for this: a notarized Farm Building & Structure Affidavit, filed with a plat or site sketch and the $75 Zoning Permit Application. A building that qualifies needs no building permit or building inspections, but it still answers to zoning and the erosion ordinance. The building cannot be residential, and the land has to have real farm operations on it.

Good to know

Before you pour or set anything, know that the county charges a $100 fine for work started ahead of the permit and $100 to come back if a job is not ready for inspection. The Planning Department checks FEMA maps to tell you if a parcel is in the 100-year flood plain. Wetlands questions go to the Army Corps of Engineers. A false farm affidavit can bring a misdemeanor charge with fines up to $2,500, so answer it carefully.

Common questions

Do I need a permit for a carport in Sussex County?
Yes for zoning. The county requires a Zoning Application, site plan and erosion screening form for carports. Building Inspections at 434-246-4390 can tell you whether a small one-story carport also qualifies for the state's exemption from a building permit.

Do I need a permit for a metal garage or shed in Sussex County?
A shed goes through the same zoning steps as a carport. The county's exempt list names utility sheds under 256 square feet for the building permit, so a larger shed or a typical garage needs one.

How does the farm affidavit work in Sussex County?
You answer questions about the farm use, sign in front of a notary, and turn it in with a site sketch and the Zoning Permit Application. The Director of Planning & Zoning and the Building Official both sign off on it.
