Spotsylvania County

Spotsylvania County, VA Permits for Metal Carports and Garages

Virginia

Yes, plan on a Spotsylvania County carport permit, because the county's accessory packet has its own line for a prefab metal carport open on two or more sides, at $80 without electric. That line falls under accelerated review, the county's quicker path for simple projects. Close in the sides and the county treats the building as a garage, which moves it to regular review with plans. Zoning approval applies to every structure here no matter how small, so even a tiny shed has to meet setbacks.

When a permit is required

  • Prefab metal carport open on two or more sides: accelerated review, $80 without electric
  • Shed of 256 sq ft or less: accelerated review, $65 without electricity
  • Detached garage, storage building, stick-built carport or any detached roofed structure over 256 sq ft: regular review, $230 deposit with more fees due at issuance
  • Small shed or enclosed structure in an RPA, Reservoir District, flood zone other than X or proffered subdivision: regular review, $130 deposit
  • Land disturbance of 2,500 sq ft or more: erosion review, wherever the lot is

Zoning and setbacks

Spotsylvania requires zoning approval for all structures regardless of size. The Agreement in Lieu in the accessory packet keeps detached structures at least 10 feet from rear and side lot lines, or 5 feet in a cluster subdivision. A three-sided carport may reach into a side yard by up to 5 feet but can't get closer than 5 feet to that line. Lots under 2 acres can't have an accessory in the front yard, and nothing can sit in an easement. Proffered subdivisions always get a regular zoning review. Zoning staff answer at 540-507-7434.

What to bring

  • Completed application signed by the landowner, or a Power of Attorney, signed contract or Landowner Representative Affidavit
  • Copy of your contractor's Virginia license, or the Landownership Exemption statement if you are doing the work yourself
  • Site or plot plan showing the building, distances to property lines and any easements
  • Manufacturer's installation guide for a metal carport
  • Well and Drainfield Affidavit if the property has a well or septic system
  • Building plans, construction documents and a site plan for anything over 256 sq ft

Farm buildings

Virginia law takes true farm buildings out of the building code, though a farm building run as a restaurant doesn't qualify and flood plain and mudslide rules still count. Spotsylvania calls these farm exempt structures and lists silos and pole barns used only for agriculture as examples. They are allowed in the A-2, A-3, R-A and Ru districts on at least 2 acres for non-livestock use or at least 5 acres for livestock. You turn in the Farm Exempt Structure Form with the permit application, and the county says filling it out does not guarantee approval.

Good to know

The Agreement in Lieu is off the table if the project is in an RPA, within 100 feet of a waterbody, or disturbs more than 2,500 sq ft. The county says detached garages and sheds in an RPA need an exception process with a public hearing and fees, starting with a Water Quality Impact Assessment. Accelerated fees are paid in full at submittal, and card payments add 2.70 percent. A permit goes void if work doesn't start within six months of issuance. The Permit Center is open Monday through Friday, 8 a.m. to 4:30 p.m., and closes from 8 to 9 a.m. on the second Wednesday of each month for training.

Common questions

Do I need a permit for a carport in Spotsylvania County?
Yes for the prefab metal carports the county's packet describes. It lists them under accelerated review at $80 without electric, as long as the carport is open on two or more sides. For a carport over 256 sq ft, call the Permit Center first, because the packet also sends detached roofed structures of that size to regular review.

Do I need a permit for a metal garage or shed in Spotsylvania County?
Yes to zoning approval either way. A shed of 256 sq ft or less goes through accelerated review at $65 without electricity. A detached garage of any size, or a building over 256 sq ft, goes through regular review with a $230 deposit for the larger structures and plans to review.

How close to my property line can a metal building go in Spotsylvania County?
The Agreement in Lieu sets 10 feet from rear and side lot lines, or 5 feet in a cluster subdivision. Zoning at 540-507-7434 can confirm your lot, especially in a proffered subdivision or an RPA.
