Orange County

Orange County, VA Permits for Metal Carports and Garages

Virginia

Yes if it is over 256 sq ft: Orange County's own FAQ requires both a zoning permit and a building permit for accessory structures that size. Smaller accessory structures get lighter treatment on that FAQ, but carports are not in the state's shed exemption, so check before treating an Orange County carport permit as optional on a small unit. One catch: an accessory building is allowed only if a main structure such as a house is already on the property.

When a permit is required

  • Over 256 sq ft: zoning permit and building permit, per the county FAQ.
  • Over 150 and up to 256 sq ft: the FAQ calls for a zoning permit but no building permit for sheds and other accessory structures.
  • 150 sq ft or less: the FAQ says no permits are required.
  • Carports of 256 sq ft or less: USBC 108 does not list carports, so confirm with Development Services before relying on the size tiers above.
  • Every size: the structure must meet district setbacks, be smaller than the main structure, and sit on a property that already has a main structure.

Zoning and setbacks

Sheds and garages must meet the minimum yard requirements of the zoning district, and setbacks and yards are measured to or from the foundation. Under county guidance approved in 2017, overhangs may reach up to 3 feet into a required setback. That same guidance limits the 50-foot waterbody or stream buffer (25 feet at Lake of the Woods) to dwellings, so it does not apply to sheds and garages. Primary highway setbacks override district requirements. The county's zoning FAQ gives no setback numbers by district, so call Planning & Zoning or check Chapter 70 of the county code for yours. Floodplain is regulated through zoning and can be turned on as a layer in the county's zoning map viewer.

What to bring

  • Zoning Permit Application and Building Permit Application, as applicable.
  • Copy of the recorded plat showing setbacks on all four sides of the project.
  • Building plans for the project.
  • Health Department as-built for the drain field, well and house area. If you do not have one, the Health Department can do a walk-over for an accessory structure or garage.
  • Copy of the contractor's state license, if one is doing the work.

Farm buildings

State law exempts farm buildings and structures under Code of Virginia ยง 36-99 and USBC Section 102.3, restaurant use excluded, with flood plain and mudslide rules still in effect. Orange County posts a Farm Buildings or Structures Exemption Form and says no inspections or Certificate of Occupancy are needed for an exempt building. The zoning code defines a farm as at least five acres in active commercial production with at least $1,000 a year in gross sales. Buildings in the 100-year floodplain or in the approach zones of the Orange County Airport or Gordonsville Municipal Airport are not exempt for zoning.

Good to know

Building Inspections keeps hours of 8:00 a.m. to 5:00 p.m., Monday through Friday, and the county main line is 540-672-3313. Inspections are included in permit fees, though re-inspections may cost extra. Permit fees are set by the FY27 Tax and Fee Schedule, which has a garage or carport line and adds a 2 percent state surcharge. Staff give a fee estimate, with the final number worked out after plans are submitted.

Common questions

Do I need a permit for a carport in Orange County?
Over 256 sq ft, yes, you need both zoning and building permits. Under that, the county's size tiers are written around sheds and other accessory structures, and carports are not in the state exemption, so call 540-672-4574 first.

Do I need a permit for a metal garage or shed in Orange County?
Up to 150 sq ft, the county FAQ says no permits. From 151 to 256 sq ft you need a zoning permit only, and above 256 sq ft both permits are required. Setbacks apply at every size.

Can I put a garage or carport on vacant land in Orange County?
Not as an accessory building. The county allows accessory structures only once a main structure, such as a house, is in place, and they must be smaller than it.
