Nelson County, VA Permits for Metal Carports and Garages

Virginia

Most likely yes, since Virginia's shed exemption leaves carports out and Nelson County posts no size cutoff of its own. To sort out a Nelson County carport permit, call Building Inspections in Lovingston at 434-263-7080. Planning & Zoning uses your plat to check building setbacks and flood maps, and it must sign off before a Certificate of Occupancy is issued.

When a permit is required

  • Carports and garages: the county's posted permit process has no separate section for them, and no small building cutoff. Call to confirm for your project.
  • Sheds: state code exempts one-story detached tool and storage sheds of 256 sq ft or less from a building permit. Ask Planning & Zoning at 434-263-7090 whether zoning review still applies.
  • Trade work: electrical, plumbing, gas and mechanical are permitted and inspected separately.
  • Land disturbing: the county requires erosion control paperwork for land disturbance, usually the Agreement in Lieu of an E&S Plan on a single family site. Ask whether your pad needs it.

Zoning and setbacks

The zoning ordinance sets accessory rules by district. In A-1, an accessory building must be at least 15 feet from a property line and cannot sit in the required front yard (§ 4-3-4). In R-2, it must be at least 5 feet from a rear line and 10 feet from a side line, and one within 10 feet of a lot line is limited to one story (§§ 6-1-6, 6-6-4). All R-2 accessory buildings must be shorter than the main building. Nelson County is also updating its zoning ordinance, so confirm these with Planning & Zoning, 434-263-7090, before you set a location.

What to bring

  • General Permit Application and the Building Permit Application Checklist
  • Two copies of plans and specifications
  • One copy of the property plat, showing the structure, distances to property lines and right of way, and existing buildings
  • Name and DEQ certification number of the Responsible Land Disturber, when a land disturbing permit applies
  • List of contractors, licensed by DPOR and holding a current Nelson County business license. Homeowners applying in their own name sign an affidavit accepting responsibility for the work.
  • Payment at submission

Farm buildings

For a true farm building, Code of Virginia § 36-99 and USBC Section 102.3 lift the building code requirement, restaurant use aside, while flood plain and mudslide rules remain in force. Nothing we found on Nelson County's pages describes a local sign-off for this. Since Planning & Zoning checks setbacks and flood maps on regular permits, ask them how a farm structure gets reviewed.

Good to know

Footing depth here depends on where you are: the county's Mandatory Inspections sheet calls for 18 inches east of Route 151 and 24 inches west of it. Projects valued over $5,000 pay $5 per $1,000 of value plus a 2% state levy, and a not ready inspection costs $25.00. The permit card must be visible from the road before the first inspection, and the setback inspection expects property lines flagged or string-lined. Card payments are taken by phone at 434-263-7080, and checks go to County of Nelson.

Common questions

Do I need a permit for a carport in Nelson County?
Most likely. The state's shed exemption does not list carports, and the county posts no size rule of its own, so call Building Inspections at 434-263-7080 with your dimensions for a firm answer.

Do I need a permit for a metal garage or shed in Nelson County?
Plan on a building permit for a garage. The county's inspection sheet refers to detached garages and garage slabs. A shed of 256 sq ft or less is exempt from a state building permit, and Planning & Zoning can tell you about any zoning review.

How far must my carport be from the property line in Nelson County?
It depends on your district. In A-1 the ordinance says 15 feet from a property line and out of the required front yard. In R-2 it says 5 feet at the rear and 10 feet at the side.
