Lancaster County, VA Permits for Metal Carports and Garages

Virginia

Plan on a permit for a garage here, and for a carport too: the county's application lists Detached Garage and Accessory Building, but does not name carports, so call before you order. For a Lancaster County carport permit, zoning and building are handled on one combined form, the Building/Zoning Permit Application Residential Only. The county says zoning is required for any accessory building, even a small pre-built shed. Review takes at least 3 business days, and incomplete applications are not accepted.

Permit office: Lancaster County Building Office

When a permit is required

  • Zoning approval ($50) for any accessory building, including small pre-built sheds
  • Building permit for a detached garage or accessory building over 256 sq ft, at the residential rate of $0.12 per sq ft with a $50 minimum
  • Separate electrical, plumbing or mechanical permits ($50 each) if the building gets that work
  • Erosion and sediment control when land disturbance goes over 2,500 sq ft ($50 agreement in lieu on single-family residences)

Zoning and setbacks

Lancaster County zoning checks your building's spot against setbacks from neighbors, road rights-of-way and tidal waters, and the distances become binding once you and the Zoning Officer sign. The county's landowner brochure lists 5 feet from any adjoining property line for one-story accessory buildings, 20 feet for anything taller than one story, and 50 feet from any road right-of-way. Setbacks within 2 feet of the minimum must be verified by a surveyor, so adding 2 feet saves that cost. Inside Irvington, White Stone or Kilmarnock the county does not issue the zoning permit, so bring an approved one from the town. Zoning questions go to the Planning & Land Use Office at 804-462-5220.

What to bring

  • Building/Zoning Permit Application Residential Only
  • Site plan drawn to scale showing distances to property lines, road rights-of-way and any Resource Protection Area (a hand-drawn footprint sketch can support a shed-size zoning permit)
  • Building plans (one copy)
  • Statement of Contractors with license numbers, or the Owner's Affidavit if you are building on your own primary residence
  • Agreement in Lieu of E & S and Agreement in Lieu of a Stormwater Management Plan
  • WQIA form and Bay Act Site Plan if you encroach in an RPA buffer
  • Flood Elevation Certificate if the site is in the 100-year floodplain

Farm buildings

Farm buildings and structures are exempt from the building code under Code of Virginia ยง 36-99 and USBC Section 102.3. Lancaster County's permit pages post no farm building form or procedure, and the application does not list farm buildings, so ask the Building Office at 804-462-5480 what paperwork it wants, including whether zoning still applies.

Good to know

Waterfront lots carry extra rules. The first 100 feet landward of wetlands is a protected buffer where new roofs and gravel drives are not intended, and a Bay Act waiver runs $300. Permits taken out after work starts cost double, per the county brochure. Do not pay until the office sends a permit number and amount; online payments carry a 2.45% fee. Footing and erosion inspections are requested on the inspection line, 804-462-0241, and calls before 2:30 p.m. go on the next business day.

Common questions

Do I need a permit for a carport in Lancaster County?
Plan on it. The county's forms do not name carports, but zoning is required for any accessory building, so a Lancaster County carport permit starts with a call to 804-462-5480 to learn how yours gets classified.

Do I need a permit for a metal garage or shed in Lancaster County?
A garage or a storage building over 256 sq ft needs a building permit at $0.12 per sq ft plus $50 zoning. A one-story storage shed of 256 sq ft or less skips the building permit but still needs the $50 zoning approval and must meet setbacks.

Can I build near the water in Lancaster County?
Tidal shores and wetlands carry a 100-foot vegetated buffer called the Resource Protection Area. Encroaching takes a WQIA form and a Bay Act Site Plan, and an RPA survey must be received before inspections.
